Terms of service

These general terms and conditions of use (GTCU) set out the legal framework and terms of access to and use of the alex.wecareatwork.com platform (hereinafter referred to as "the site"). They can be accessed at any time in the "Terms and Conditions" section at the bottom of the site page.

 

The user of the site (the "User") acknowledges that he/she has read the Terms and Conditions of Use and accepts them without restriction. To create an account, the User must read and accept the GCU, which constitutes a contract with the site. By registering on the site via the registration form, each User expressly accepts these GTU. In the event of refusal to accept the GCU, the User renounces access to the services offered by the site. 

 

The site reserves the right to modify or add to these general terms and conditions of use unilaterally and at any time. These modifications will come into force as soon as they are posted on the Site and will therefore be binding on all Users from that moment. The fact that the User continues to use the Site implies that he/she has accepted the General Terms and Conditions of Use as amended from time to time.

 

Article I: Access to the Site

 

I.1 Site accessibility

The Site is accessible anywhere to any User with Internet access. All costs incurred by the User in accessing the service (hardware, software, Internet connection, etc.) are at the User's expense.

 

The site provides Users with access to various information concerning the support and management of chronic diseases in the workspace. The site provides access to a self-training digital pathway aimed at general scheme employees. It helps to identify best practices for reconciling illness and work, from the time of diagnosis through to resumption of professional activity.

I.2 Use of the site 

Users of the site must be at least 18 years of age. 

 

Access to the member area is subject to registration. 

 

In order to register and benefit from the services offered online by the Site, each User must first create a User Account, providing personal data essential to the proper operation of the person-to-person matchmaking service (a valid e-mail address), as well as a connection code (provided by the organization offering the service).  

 

The member area can then be accessed by identifying the User with his/her chosen username / e-mail address and password. These are strictly personal and the User undertakes not to divulge them to any third party.

 

By registering and accepting these GCU, each User agrees to receive occasional e-mails from the platform, the purpose of which is to share information, advice or a satisfaction questionnaire.

 

I.3 Site content entered by Members

 

KEPLER HR - owner of the Wecare@work brand and the Alex service - is not responsible for the content entered on the site by Members. 

 

The User undertakes to provide truthful and honest information and to update it where necessary. This information may be accessed and modified at any time.

 

However, as soon as it is brought to the attention of Société KEPLER HR that a content infringes the rights of a third party, Société KEPLER HR will do its utmost to remove the litigious content from the site.

 

I.4 Obligations of the User

 

The User guarantees that he/she will not use the site for illicit purposes and undertakes to comply with national and international laws and regulations in force. 

 

The User shall be solely liable for any material and/or immaterial and/or direct or indirect damage of any nature whatsoever that he or she may cause to the company or to third parties as a result of improper use of the Site. In the event of a breach by the User of its legal and contractual obligations, the Company reserves the right to take legal action to put an end to any such breach and to obtain compensation for its loss.

 

Article II: Personal data

The User is informed that his registration or browsing on the Site gives rise to the automated processing of personal data concerning him, in compliance with Law 78-17 of January 6, 1978 on Data Processing, Data Files and Individual Liberties and the RGPD (General Data Protection Regulation) which came into force on May 25, 2018.

Article III: Literary and artistic property

The ALEX site, its content and all its constituent elements are creations for which KEPLER HR holds all intellectual property rights and/or has obtained exploitation rights, in particular under copyright, design rights, database rights and trademark rights.

 

The ALEX site, including text, graphics, sound and audiovisual elements, monitoring tools, software, database structures, text, information, analyses, logos and all other content/adaptations, is the property of Kepler HR, the site's publisher.

 

In particular, the User agrees not to reproduce and/or represent, download, sell, distribute, issue, translate, adapt, exploit, distribute, broadcast or communicate, in whole or in part in any form whatsoever, for commercial or non-commercial purposes, any original work of the mind or data contained on the Site, other than for private use.

 

The User also undertakes not to introduce any data to the Site that would modify or be likely to modify the content or appearance of the data, presentation or organization of the Site or of the works appearing on the Site, and by any means whatsoever. 

 

Any reproduction, representation in whole or in part of this Site and its contents, including any intellectual or industrial property rights or databases, by any means whatsoever, without the express authorization of KEPLER HR is prohibited and constitutes an infringement punishable under Articles I, III, V and VII of the French Intellectual Property Code, and the perpetrator will be held both civilly and criminally liable.

Article IV: Responsibilities

Use of the Site is at the User's own risk and under his/her sole responsibility. It is the User's responsibility to take all appropriate measures to protect his/her own data and/or software stored on his/her computer equipment against any attack.

 

Any material downloaded and/or obtained in any way whatsoever while using the Site is done so at the User's own risk, and KEPLER HR shall in no way be liable for any loss of data or damage to the User's computer. 

 

The information transmitted by the site is deemed reliable, but the site does not guarantee that it is free of errors, omissions or defects. 

 

Furthermore, KEPLER HR cannot be held responsible for the interpretation or use of information available on the site in the event of any material and/or immaterial and/or direct or indirect damage of any nature whatsoever caused by the use or impossibility of use of the Site. 

 

The Site shall not be held liable for any event of force majeure resulting in malfunction of the Site or server, subject to any interruption or modification for maintenance purposes. 

 

In such cases, the User agrees not to hold Société KEPLER HR responsible for any interruption or suspension of service, even without prior notice.

 

Société KEPLER HR cannot be held responsible for the non-operation, impossibility of access or malfunctioning of the Site attributable to unsuitable equipment, malfunctioning of the services of the User's access provider, or those of the Internet network. The same applies to all other reasons beyond the control of KEPLER HR.

 

The User declares that he/she is fully aware of the intrinsic characteristics of the Internet, and in particular of the fact (i) that data transmission on the Internet is only relatively reliable, as data circulates on heterogeneous networks, with varying characteristics and capacities, which are sometimes saturated at certain times of the day, thus affecting download times or data accessibility, and (ii) that the Internet is an open network, (ii) that the Internet is an open network and, as a result, the information it carries is not protected against the risks of misappropriation, intrusion into its system, piracy of data, programs and files on its system, or contamination by computer viruses, and (iii) that it is the customer's responsibility to take all appropriate measures to protect the data, files or programs stored on its system against contamination by viruses or attempted intrusion into its system.

 

Article V: Embedded content and hypertext links

Site pages may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other sites behaves in the same way as if the visitor were visiting that other site.

 

These websites may collect data about the User, use cookies, embed third-party tracking tools, track your interactions with such embedded content if the User has a logged-in account on their website.

 

Hypertext links may be present on the site. The User is informed that by clicking on these links, he/she will leave the alex.wecareatwork.com site, which has no control over the web pages to which these links lead and cannot, under any circumstances, be held responsible for their content.

 

Article VI: Applicable law and jurisdiction

These General Terms and Conditions of Use are governed by and subject to French law.

At any time, the User may contact the site administrators and address any request by sending an e-mail to bonjour@wecareatwork.com.

All disputes arising from the application of the present General Conditions of Use, concerning their validity, interpretation or execution, and which cannot be resolved between the User and KEPLER HR, will be submitted to the competent courts under the conditions of common law.
